What Is the I-9 Form?

The I-9 form, also known as the Employment Eligibility Verification form, is a document mandated by the Immigration Reform and Control Act of 1986 and issued by the United States Citizenship and Immigration Services (USCIS). The I-9 form verifies the identity of paid employees in the United States. The form must be properly completed and signed by an authorized official.

When filling out the I-9 form, you must present acceptable identification documents. These can be found in lists A, B, or C on the form’s last page. These documents can include a U.S. Passport, a Permanent Resident Card, or an Alien Registration Receipt Card. If an employee does not have the required document, the employer can help them obtain one.

The name that appears on the document must match the name on the Form I-9. If the name on the document changes, it is necessary to provide proof. If the employee has changed their name, they must provide a certified copy of the new name. These documents should be issued by a state, county, or municipal authority. Social Security cards must also be original documents. They cannot be plastic replicas or have a statement stating “not valid for employment purposes.”

Required fields to be filled out

The Form I-9 form includes several required fields that an employee must complete. The employee’s name, employer’s name, and state of business must be entered. In addition, the business’s ZIP code must be entered. If one or more of these fields is left blank, a warning message will appear. The employee’s employment history must also be entered on the form.

Previously, only last names were required for this section. However, USCIS narrowed the requirement to “other last names” to avoid discrimination and protect the privacy of transgender and protected individuals. For example, if an employee has legally changed their last name to “Smith,” they should enter this information in the appropriate field.

Documents to be reviewed by authorized official

When a company uses an I-9 form to hire new employees, they must physically examine the documents before hiring them. The documents must be original and unexpired. Moreover, photocopies are not acceptable. The documents that an employee presents must be of their own choice. They cannot be forced to present more documents than the ones requested on the I-9 form.

There are many requirements for the I-9 form. The document presented should be genuine and relate to the employee. It should be signed by the authorized official. If the documents are fake, the employer could be facing civil penalties and back pay.

Common errors to be corrected on i 9 form

Most employers overlook certain parts of the I-9 form when filling it out. This makes it important to make sure the form is properly filled out and legible before submitting it. While you should not use a Wite-Out pen to correct any mistakes on the form, you should at least mark the mistake and enter the correct information next to it.

Many employees don’t complete Section 3. This section must be completed when the employee’s work authorization expires, or when the organization rehires the employee. You should also attach copies of the employee’s legal identification.
